This agreement is entered into by and between: MAKENZIE CONKLIN and Client.

This agreement ("Agreement") begins at the date of purchase ("Effective Date") and is valid for 6 months from date of purchase.


1. SERVICES PROVIDED

MAKENZIE agrees to provide the following services as she sees fit; Life Coaching, Somatic modalities and concepts, Hypnosis/Energy Work and/or mentorship. MAKENZIE agrees to provide services related to life coaching and business mentoring, which includes but is not limited to access to the Coach's content, resources, courses, masterclasses, and business expertise.


2. TERMS OF AGREEMENT

The term of this CONTAINER agreement is 6 months. It consists of the inclusions mentioned below. This does not include face to face offerings.

3. PAYMENT AND FEES

The total fee for the services provided under this Agreement is payable as $3,997 USD which has required a deposit, and the appropriate payment plan.

If you are using a payment plan you are obligated to pay as agreed, on the dates agreed and in full, regardless of how you utilize The Container or if you choose to not participate in The Container.

This container is non-refundable, NON TRANSFERRABLE, NON EXCHANGEABLE regardless of how you utilise it, even if you choose to not participate. Change of mind IS NOT TOLERATED.

Your payments come out on the same day each month you paid your deposit - if you fail to make a prompt payment, you will be charged a late fee of $25, removed from your container, and cannot continue until you are two payments ahead.

It is your responsibility to also make note of all dates that have payments coming out. If you have committed to multiple payment plans, then you have committed to multiple dates. These dates cannot be changed or moved once purchased unless agreed upon by MAKENZIE.

If you need your payment plan paused, changed or bundled you will incur a $25 admin fee per container requiring administration. These changes will not happen until the admin fee has been paid.

In the result of injury, death, or unforeseen circumstances that change your ability to pay your container, this will be reviewed by MAKENZIE personally on how to move forward.

If you decide to break your commitment by terminating your container, pausing your container, or changing the container the below will apply:

you forfeit agreed pricing and will now have current pricing
you may be blacklisted from payment plans and will only offered pay in full agreements
you forfeit all money paid, plus content/containers given to you, and lose your lifetime access

4. CANCELLATION POLICY

You agree that all sessions booked in at the start of your container are your set sessions.

If you can't make a session this is to be communicated as soon possible as possible VIA EMAIL to support@makenzieco.com. If communicated with less than 3 days' notice the sessions will be forfeited unless extreme circumstances apply.

If you do not communicate that you are going to be late, MAKENZIE will wait 5 minutes ONLY, and after that, you will have forfeited your session. It is your responsibility to communicate clearly and be on time.

5. REFUNDS

We will not be liable for any failure to perform the Services to the extent that it is caused by your noncompliance with your obligations under the Agreement. The services are non-refundable regardless of how you utilize the service.

You cannot request a refund if:
the reason for termination is outside of our control;
you change your mind;
you fail to clearly explain your needs to us; or
you insist the Services being performed in a way that is against our advice
your financial circumstances change

6. JOURNEY AGREEMENTS

By investing in this CONTAINER you understand that MAKENZIE will provide you with tools, templates, guidance, knowledge, processes and support, however, ultimately YOU are responsible to create the change results you want in your life, relationships and/or business.

You agree to FULLY respect & honor MAKENZIE’S boundaries and guidelines. When you are sent the guidelines you have 48hrs to let us know if you aren't in agreement with them. By proceeding with your first session and or opening up the Telegram you are agreeing to these terms.

7. RESPONSIBILITY & OWNERSHIP

By signing this contract you are agreeing that MAKENZIE is not responsible for your results, including but not limited to the results within your business, client numbers and retention, income, or marketing performance.

You accept, agree and understand that you are fully responsible for your progress and results. We do not offer any professional legal, medical, psychological or financial advice.

You agree to hold the MAKENZIE harmless from any and all claims, loss, or expense.

8. PRIVACY AND CONFIDENTIALITY

By signing this contract, you are agreeing that you will not provide MAKENZIE’S personal information, WhatsApp number or Telegram/Voxer to anyone and understand that is a breach of contract and privacy if you do.

We will anonymise any feedback and testimonials, and will not disclose any of your personal private information, on your request.

9. INTELLECTUAL PROPERTY

All coaching processes, language, spreadsheets and materials that are provided to you during the course of this container are MAKENZIE CONKLIN’S Intellectual Property. You are NOT allowed to duplicate, share, reproduce, display or publish anything she shares in any way without written permission by MAKENZIE CONKLIN.

Any training's, concepts or framework provided to the Client within a paid container is to be integrated into the Client's business and is not to be distributed, duplicated, repurposed or copied into the content of the Client's own.

This is respecting the Clients investment, MAKENZIE’S intellectual property and other clients who invest in a container with MAKENZIE.

This includes any concepts MAKENZIE shares with the Client in their sessions/Telegram/voxer although wherever applicable, you agree to - credit us with the provision of the Services.

10.TERMINATION

We may terminate the Agreement with immediate effect it:

you do not pay the Fees by the Payment Dates;
you fail to provide the Client Information or other information within a reasonable time of request;
you otherwise breach any obligation under the Agreement and or GUIDELINES;
we consider that mutual trust or confidence no longer exists; or
we determine that we are no longer able to perform the Services for any reason.
